1. Scope and Contracting Parties
These Terms and Conditions (hereinafter “Terms”) apply to all contracts between C-AR Picture UG, Beckerstraße 13, 09120 Chemnitz, Germany, registered under Commercial Register No. 37405, and natural or legal persons (hereinafter “Users”) regarding the use of the “Car AR” app, which can be accessed via mobile devices and web browsers.
The app is intended for both consumers (as defined in § 13 BGB) and business users (as defined in § 14 BGB). Specific provisions may differ depending on the user status, particularly with regard to the right of withdrawal, warranty, and liability.

2. Description of Services
The app enables users to photograph vehicles, digitally enhance the images, and prepare them for sales presentation. Users can create, manage, and store image edits, presets, and vehicle catalogs.
Details of the app’s features can be found in the app description and Section 3 of these Terms.

3. Scope of Services
The scope of services includes in particular:

1. Registration of users (individuals or businesses)

2. Creation and management of user accounts and vehicle catalogs

3. Upload and editing of vehicle images

4. Use of presets (editing templates)

5. Selection and management of image backgrounds

6. Image storage and management

7. Credit management for using paid features

8. Payment processing via Stripe

9. Access to transaction history and user activity
   C-AR Picture UG reserves the right to modify the scope of services at any time, provided the change is reasonable for the user.

4. Conclusion of Contract
The contract is concluded once the user creates an account and/or activates a paid service in the app. By booking a service, the user submits a binding offer, which is accepted by C-AR Picture UG upon activation of the service.
Before submitting an order, users can review and modify their entries at any time. The contract is concluded in the German language.

5. Prices and Payment
The prices published in the app or at www.c-ar.app at the time of booking apply.
All prices are:

• For consumers (§ 13 BGB): gross prices including applicable VAT.

• For business users (§ 14 BGB): net prices, excluding applicable VAT.
  Payment is processed via the payment provider Stripe and is due immediately. Activation occurs upon successful payment. Invoices are provided digitally.

6. Right of Withdrawal for Consumers
Consumers are entitled to a statutory right of withdrawal.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without stating any reason.
The withdrawal period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must inform us at:

via a clear statement (e.g., email) about your decision to withdraw.

Note on early expiry:
The right of withdrawal expires in the case of digital content if the user has expressly agreed that the contract is to be executed before the withdrawal period ends and has acknowledged that this waives their right of withdrawal (§ 356 (5) BGB).

7. User Obligations
Users are required to provide accurate and complete information during registration. Businesses are liable for the actions of their employees. Users are responsible for the legality of the content they transmit. In particular, no illegal, offensive, discriminatory, or third-party-infringing content may be uploaded.

8. Copyright and Usage Rights
The app and all content provided by C-AR Picture UG are protected by copyright. Users are granted a simple, non-transferable, non-exclusive right to use the app for the duration of the contract.
By uploading content (e.g., images, logos), users affirm they own all necessary rights. The user grants app-concept.com a simple usage right to process, store, and display the content in the context of app usage.

9. Warranty

• For consumers, statutory warranty rights apply.

• For business users, the warranty is limited to 12 months from the date of performance, unless otherwise required by law.

10. Liability
C-AR Picture UG is fully liable for intent and gross negligence, and for injury to life, body, or health.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations (cardinal duties), and to the foreseeable, typical damages. Any further liability is excluded.

10. Data Protection
    Information on the processing of personal data can be found in the privacy policy at:

    Processing is carried out in accordance with the GDPR. Users have the right to access, rectify, erase, and restrict data processing pursuant to Articles 15 et seq. GDPR.

12. Contract Language, Storage, and Correction
The contract language is German. The contract text is not permanently stored by C-AR Picture UG. Input errors can be corrected within the app before the order is submitted.

13. Amendments to the Terms
C-AR Picture UG reserves the right to amend these Terms for future effect, provided such changes are reasonable for the user. Changes will be communicated in good time. If the user does not object within 30 days, the amended Terms will be deemed accepted.

14. Final Provisions
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, the mandatory legal protections of their country of residence remain unaffected.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered office of C-AR Picture UG.
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
